In the recent reporting season in the UK, where the legal financial year runs from May 1 to April 30, the top eight London-based firms reported falling PEP of up to 6.6 per cent. Advertisement Global firms Ashurst and Herbert Smith Freehills revealed that PEP for the year to April 30 was steady at around $2.2 million, results both firms called “pleasing”. Eversheds Sutherland, which recently announced a tie-up with King & Wood Mallesons, was the outlier with its PEP rising by 4 per cent. The market leader was Freshfields Bruckhaus Deringer, which lifted its PEP by 1 per cent to an astounding £2.09 million ($4.06 million). Fellow “magic circle” firms Clifford Chance and Allen & Overy and Linklaters were not far behind, confirming their status as the big four of the UK industry. However, they were still well short of the top PEP firms in the US for 2022; Kirkland & Ellis was up 1.7 per cent to $US7.5 million ($11.4 million), as it overtook longtime leader Wachtell, Lipton, Rosen & Katz ($US7.29 million). Wachtell’s PEP fell 13 per cent, with Mr Josten saying it was a notable victim of the war on talent, which led to increases of 20 per cent in all major markets amid surging demand. He noted that the direct expenses (lawyers) and indirect expenses (overheads) exploded in 2021 and continued through 2022. In the final two quarters of 2022, expenses per lawyer grew by 14.4 and 15.4 per cent. Advertisement “From there, you can see the rising expenses’ effect on PEP growth. For US firms, we saw PEP decline for the first time since 2009.” Most of the UK-based firms have close ties to Australia, either through mergers (Herbert Smith Freehills and Ashurst) or boutique operations (Allen & Overy, Clifford Chance and Clyde & Co).
