Those are the two areas of focus that we saw as opportunity gaps.” The ambiguity of the NCAA’s NIL guidelines is uncharted territory for athletes, and Mannix sees Underdog advising and supporting athletes to smart business decisions in their entrepreneurial ventures. “It’s a huge opportunity to be able to be of value to those groups that are looking for guidance, how to navigate through it, the compliance aspects of it, which is different in each state,” says Mannix. “It’s a space that we’re super bullish on.” There are risks inherent in positioning an upstart business to compete against established heavyweights of the talent agency industry like Creative Artists Agency LLC or Wasserman Media Group, but the upside can be highly profitable for Underdog, says Andrew Apfelberg, a Los Angeles-based attorney at Greenberg Glusker. “That’s going to require a lot of capital,” Apfelberg says. “But to go into areas that are still highly respected, desirable, interesting and marketable but maybe haven’t gotten as much attention is absolutely brilliant from a business strategy standpoint.” As audiences evolve in their consumption habits, athletes will need to meet fans where they are, and Underdog’s business model fits that demand well, says Chip Sloan, attorney at Stradling. “What [Underdog] is doing is what so many organizations and teams are looking for,” says Sloan. “The capacity for new content, new avenues for marketing and commercial agreements and doing so in a way that is touching consumers that are really going to be driving future revenue.” NewSpring’s investment will help Underdog scale and expand with acquisitions, Sloan says. NewSpring and Underdog’s long-term success will rest in their ability to expand their reach, iterate and grow their business model to reach profitability, while staving off competitors eager to capture some of their market share, Apfelberg says. “People want to be associated with businesses that are hot, and are market disruptors,” Apfelberg says. “Not everybody has $1 million for a 30-second Super Bowl ad, but there are way more companies who might have $10,000 to sponsor an athlete at the World Cup.”
